As a hiring manager, it is not as difficult as it has been in the past to bring skilled foreign students and graduates into your organisation and the following information gives you a brief outline on how you can fulfil the legal working requirements.

Part-time workers

Often students study schedules allow for them to work anywhere from 10 hours to 32 hours per week and full-time during the summer holiday period of June, July & August.

Most citizens from EU or EEA countries do not require a work permit for this temporary work as long as they are registered with the Dutch Immigration Service. International students from outside the EU/EEA/Swiss nations who have a valid residence permit with the aim to study, can work alongside their studies each school year but must choose either :

• full-time seasonal work in June, July and August 
• part-time work of no more than ten hours a week

Students cannot do both and as an employer you will need to check if they have already had a work permit issued for the school term. If not, then you can apply for a TWV (work permit) at the Centre for Work & Income www.werk.nl

After Graduation

The Dutch government has introduced greater flexibility to students from outside the EU/EEA countries to encourage them to stay on and work as a Skilled Migrant. As of December 2007, Graduates from a University (WO) or 'Hogeschool' (HBO) in the Netherlands have the possibility to extend their stay for a period of one year to search for a job ('zoekjaar'). Students who have already changed their student residence permit to that of a zoekjaar residence permit will have a verbliifsvergunning stating 'verblijf gedurende zoekjaar afgestudeerde' (seeking work after graduation). Graduates with this residence permit status may work for up to one year without restrictions or a work permit.

If the graduate has not changed their status to that of the 'zoekjaar', then you may also hire them directly if you are registered for the Skilled Migrant Program. As a Graduate from a Dutch HBO or WO institution they will need to earn a minimum of €25.500 per annum (2009 figures indexed annually) and have a fixed term contract.
